Big Update on Spousal Open Work Permit for International Students in Canada

Canada has recently introduced significant changes to the eligibility requirements for obtaining a Spousal Open Work Permit (SOWP), marking a transformative shift for international students and their spouses. The modifications, spearheaded by Immigration, Refugees, and Citizenship Canada (IRCC), are set to impact a large section of the immigrant community seeking educational opportunities in Canada.

Key Changes Unveiled

Effective from March 19, 2024, the new regulations restrict SOWP eligibility primarily to the spouses or common-law partners of international students enrolled in advanced degree programs, specifically master’s or doctoral degrees at Canadian universities or polytechnic institutions. This represents a departure from previous policies, which allowed spouses of students in any full-time designated learning institution program to apply for work permits, aiming to work and gain Canadian experience alongside their studying partners. In addition to master’s and doctoral degree students, exceptions are made for spouses of undergraduate students enrolled in certain professional degree programs such as:

  • Doctor of Dental Surgery (DDS, DMD)
  • Bachelor of Law or Juris Doctor (LLB, JD, BCL)
  • Doctor of Medicine (MD)
  • Doctor of Optometry (OD)
  • Pharmacy (PharmD, BS, BSc, BPharm)
  • Doctor of Veterinary Medicine (DVM)
  • Bachelor of Science in Nursing (BScN, BSN, BNSc)
  • Bachelor of Education (B. Ed.)
  • Bachelor of Engineering (B. Eng., BE, BASc)

Notably, those who submitted their SOWP applications before March 19, 2024, will still be processed under the old criteria, provided the international student has a valid study permit and is eligible for a post-graduation work permit (PGWP), amongst other conditions.

Documentation and Eligibility

For a successful SOWP application under the new rules, applicants must present substantial evidence of their partner’s enrollment in an eligible program, including a valid Letter of Acceptance, proof of enrollment letter, or transcripts from the academic institution. Proof of relationship to the student is also required.
